Aim of policy and why we process your data

The aim of the policy is to outline how Nicola Hackett Coaching will use personal data from its contacts/clients and is abiding by data protection legislation which gives individuals the right to understand how their data is used. Our work adheres to the EMCC Code of Conduct, with confidentiality being a top priority.

In order to effectively undertake coaching work, we need to process and use a range of personal data for the administration of coaching and workshops as well as general correspondence. The personal information we collect may include name, date of birth, email address, postal address and credit/debit card details.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

Who we share your data with

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Data pertaining to coaching and training will be held by the company only for the period that is necessary by law and for compliance with HMRC requirements.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where your data is sent

Visitor comments may be checked through an automated spam detection service. All personal data collected will remain solely with the company and not passed to any 3rd party.

Video calls

Video calls are fully confidential and your session will not be recorded unless agreement is obtained from you. You will be sent details about your session by email or calendar invitation. If you would like these details to be private please ensure you use an email address that only you have access to.

Terms and Conditions for Online Coaching with Nicola Hackett

The Client: The individual being coached and, if applicable, the company being invoiced for the coaching services.

The Coach: Nicola Hackett and any professional coaches contracted by Nicola Hackett.

1) Coach-Client Relationship

The Coach agrees to maintain the ethics and standards established by the European Mentoring and Coaching Council (EMCC) and International Stress Management Association (ISMA).

  • The Client is solely responsible for creating and implementing their physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship and their coaching sessions.
  • The Client acknowledges that coaching is not therapy and does not substitute for therapy or other professional advice if needed. Coaching does not prevent, cure, or treat any mental disorder or medical disease.
  • The Client may terminate or discontinue the coaching relationship at any time, subject to Clause 8 and the appropriate notice period.
  • Coaching is a comprehensive process and may involve various areas of the Client’s life.
  • Coaching does not involve diagnosis or treatment of mental disorders. If under the care of a mental health professional, the Client is advised to inform the Coach during the onboarding process.
  • To maximise the coaching relationship, the Client agrees to communicate honestly, be open to feedback, and actively participate in the programme.

2) Services and sessions

  • Coaching and mentoring sessions will be delivered via video call on the Microsoft Teams platform. The specific number and type of sessions will be detailed in the invoice provided to the Client.
  • The initial session should be booked by the client online at nicolahackett.coach then subsequent sessions within a package will be scheduled by mutual agreement between the Coach and the Client and the Coach will send out a MS teams invite.
  • Each session will be 60 minutes long, as specified in the invoice.

3) Fees

  • Fees are payable in advance via nicolahackett.coach and processed either via stripe or paypal.

4) Procedures

  • The Client will initiate scheduled video calls via the agreed platform (e.g., Teams). Any changes to meeting details will be communicated in advance.
  • The Coach will maintain personal notes for their records, which will not be shared unless agreed otherwise.

5) Confidentiality

The coaching relationship and all shared information are bound by EMCC/ISMA confidentiality principles. However, the relationship is not protected by legal privilege.

  • The Coach will not disclose information without written consent, except where:
    • Required by law or court order.
    • There is an imminent risk of harm to the Client or others.
    • Illegal activity is disclosed.
  • Confidentiality exclusions include:
    • Information known prior to the relationship.
    • Publicly known or independently developed information.

6) Cancellation Policy

  • Sessions must be cancelled or rescheduled at least 24 hours in advance. Sessions cancelled within 24 hours may be charged in full. Exceptions will be considered on a case by case basis.
  • Fees for unused sessions are non-refundable once the programme has been paid.

7) Limited Liability

The Coach makes no guarantees or warranties regarding the outcomes of coaching services. The Coach’s liability is limited to the total fees paid by the Client under this agreement.

 

8) Dispute Resolution

Disputes will be mediated in good faith for 30 days. If unresolved, legal action may follow. The prevailing party in any legal action will recover attorney fees and court costs.
